Terms and Conditions of Sale

Article 1 — Purpose

These General Terms and Conditions of Sale (GTC) govern the contractual relations between MOOD SPORT, the seller, and any individual or legal entity wishing to make a purchase via the moodsport.fr website, hereinafter referred to as "the Client".

Any purchase made on the site implies full and unreserved acceptance of these GTC.

Article 2 — Products

The products offered for sale are those listed on the moodsport.fr website at the time of the order. Each product is presented with a description and a price indicated in euros including all taxes (TTC).

MOOD SPORT reserves the right to modify its product catalog and prices at any time.

Article 3 — Prices

Prices are indicated in euros (EUR) including all taxes. MOOD SPORT reserves the right to modify its prices at any time, it being understood that the price applied to the order will be the one in force at the time of its validation.

Article 4 — Order

The Client places their order online from the moodsport.fr website. The order is definitively registered after payment validation. A confirmation email is sent to the Client at the address provided during the order.

MOOD SPORT reserves the right to cancel any order in case of availability or payment issues.

Article 5 — Payment

Purchases can be paid for using the following methods:

• Bank card (Visa, Mastercard)
• PayPal
• Apple Pay

Payment is secured via the Shopify Payments platform. The Client's bank details are encrypted and are not retained by MOOD SPORT.

Article 6 — Delivery

Delivery time: Orders are shipped within 1 to 3 business days after payment validation. The estimated delivery time is between 7 and 10 business days depending on the destination.

Delivery fees:

• Metropolitan France: free delivery
• International and DOM-TOM: delivery fees calculated automatically at the time of order based on the destination

In case of delivery delay, MOOD SPORT cannot be held responsible for the consequences due to this delay.

Article 7 — Right of withdrawal

In accordance with Article L221-18 of the Consumer Code, the Client has a period of 15 days from receipt of their order to exercise their right of withdrawal, without having to provide reasons or pay penalties.

To exercise this right, the Client must contact us via the website's contact form before the deadline expires.

Products must be returned in their original condition, unused, and in their original packaging. Return shipping costs are at the Client's expense.

Reimbursement will be made within 14 days from the receipt of the returned products.

Article 8 — Warranty

All MOOD SPORT products benefit from a 2-year warranty against manufacturing defects, in accordance with current French legislation (Articles L217-4 and following of the Consumer Code).

The warranty does not cover damage resulting from abnormal use, an accident, or normal wear and tear of the product.

Article 9 — Customer service

For any questions or complaints, the Client can contact MOOD SPORT via the contact form available on the moodsport.fr website. Our team is committed to responding within 24 business hours.

Article 10 — Personal data

Personal data collected during the order is used solely for processing the order. In accordance with the GDPR, the Client has the right to access, rectify, and delete their data. To exercise this right, contact us via the contact form.

Article 11 — Intellectual property

All elements of the moodsport.fr website (texts, images, logos, visuals) are protected by intellectual property law. Any reproduction without authorization is prohibited.

Article 12 — Applicable law and disputes

These GTC are subject to French law. In case of dispute, the Client will first contact MOOD SPORT for an amicable resolution. Failing this, French courts will have sole jurisdiction.

In accordance with the provisions of the Consumer Code, the Client may resort to a consumer mediator in case of an unresolved dispute.
